Welcome to Fast8D! These Terms of Service ("Terms", "Agreement") govern your access to and use of our institutional website (fast8d.com) and our cloud-based SaaS platform (app.fast8d.com), dedicated to quality claims tracking, non-conformance management, and corrective action workflows using the Eight Disciplines (8D) methodology.

By registering an account, accessing, or using the Fast8D platform, you agree to be legally bound by these Terms. If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity.

1. Description of the Service

Fast8D provides a multi-tenant cloud software-as-a-service application that allows organizations to:

Document, analyze, and manage manufacturing non-conformances and customer complaints.
Execute structured 8D problem-solving workflows (D1 through D8).
Collaborate within designated tenant workspaces with team members and external suppliers.
Manage approvals, notifications, and export audit-ready 8D reports.

We reserve the right to modify, enhance, or deprecate features of the Service to improve performance or adapt to technical requirements, provided core functionality is not materially reduced.

2. Tenant Accounts, User Roles, and Free Trial

A. Account Creation

To access the platform, you must register an account using a valid corporate or personal email address and secure credentials via AWS Cognito. You are responsible for safeguarding your login credentials.

B. Tenant Owners vs. Invited Users

Tenant Owners: The legal entity or individual that creates the workspace and holds the billing relationship. Tenant Owners have full administrative control over the workspace, user invitations, and data access policies.
Invited Users: Quality managers, engineers, plant personnel, or supplier representatives invited by a Tenant Owner to collaborate on specific 8D claims. Invited users do not pay any subscription fees; their platform access is fully covered by the Tenant Owner who sponsors their workspace.

You agree not to share account credentials across multiple individuals. Each seat is intended for a single named user.

C. Free Trial

New Tenant Owners are entitled to a 10-day free trial upon initial account registration to evaluate the platform without charge. No payment is required until the conclusion of the free trial period.

3. Subscriptions, Fees, and Refund Policy

A. Subscription Plans

Access to the Fast8D application is provided on a subscription basis (e.g., Monthly or Yearly billing cycles) according to the pricing tier selected at registration.

B. Billing and Processing (Stripe)

Payments are securely processed through our third-party payment gateway, Stripe. We do not store raw credit card numbers or banking credentials on our servers.
Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date via the customer billing portal.
All fees are quoted exclusive of Value Added Tax (VAT), sales taxes, or duties, which will be charged where applicable.

C. Cancellations and No-Refund Policy

Fast8D is an immediately accessible, on-demand digital SaaS product. Consequently, all subscription fees paid are non-refundable.
Customers are encouraged to thoroughly evaluate the platform during the 10-day free trial or opt for a flexible monthly subscription plan.
Tenant Owners may cancel their subscription at any time through the billing portal. Cancellation will take effect at the end of the current pre-paid billing period, with no further recurring charges.

4. Proprietary Rights and Data Ownership

A. Customer Data Ownership

You retain full ownership of all data, reports, attachments, and proprietary root-cause analyses uploaded to your tenant workspace ("Customer Data"). Fast8D claims no ownership rights over your quality records, defect descriptions, or supplier communications.

B. Fast8D Intellectual Property

Fast8D and its licensors retain all right, title, and interest in and to the platform, including software code, UI designs, algorithms, databases, logos, and trademarks. You may not copy, modify, distribute, reverse engineer, or decompile any part of the service.

C. Limited License to Fast8D

You grant Fast8D a limited, non-exclusive license to host, process, and transmit Customer Data solely to the extent necessary to provide and maintain the Service and comply with legal requirements.

5. Acceptable Use Policy

You agree not to use Fast8D to:

Violate any applicable local, national, or international laws or regulations.
Probe, scan, or test the vulnerability of our systems without prior written authorization.
Circumvent or attempt to tamper with security controls, rate limiters, or AWS WAF protections.
Upload malicious code, viruses, trojans, or harmful attachments.
Scrape, crawl, or harvest data through automated bots or spiders.
Transmit unsolicited commercial messages or spam.

We reserve the right to suspend or terminate access immediately upon discovering any violation of this Acceptable Use Policy.

6. Security, Hosting, and Availability

A. Infrastructure and Security

The Service is hosted on enterprise-grade cloud infrastructure powered by Amazon Web Services (AWS) in compliance with ISO 27001 and SOC 2 standards. We enforce modern encryption standards in transit (TLS 1.3) and at rest (AES-256), alongside active web application firewall (AWS WAF) mitigation.

B. Service Level and Maintenance

We strive to maintain high system availability (aiming for 99.5% uptime).
Routine maintenance will be scheduled during off-peak hours whenever feasible, with advance notice communicated where appropriate.
The Service is provided on an "as is" and "as available" basis.

7. Confidentiality

Both parties agree to treat all business, technical, and quality non-conformance records disclosed during the use of the platform as strictly confidential. Neither party will disclose confidential information to any third party without prior written consent, except to authorized service providers (e.g., AWS, Stripe) or as required by law.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

In no event shall Fast8D, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, production downtime, data loss, or business interruption.
Fast8D's total aggregate liability arising out of or related to this Agreement shall not exceed the total amount paid by the Customer in the twelve (12) months preceding the incident giving rise to liability.

9. Term, Termination, and Data Export

A. Term

This Agreement commences on the date you first access the Service and continues until terminated by either party.

B. Data Export upon Termination

Upon account termination or cancellation:

Tenant Owners may request an export of their 8D reports and associated claim records within 14 days following the effective cancellation date.
Following the expiration of this 14-day request window, all Customer Data will be permanently and securely deleted from production databases.

10. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with Italian law, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the Turin.
